NEWSLETTER TERMS AND CONDITIONS

§ 1 GENERAL PROVISIONS AND CONTACT DETAILS

  1. The Newsletter service is available at www.festiwalkundalinijogi.pl (hereinafter: the “Website”) and its relevant subpages after registering via the Newsletter subscription form. The service is provided by the association BIBLIOTEKA NAUK KUNDALINI JOGI, ul. Mikołaja Kopernika 4/4, 81-846 Sopot, Poland, KRS 0000336364, NIP 5851450579, under the terms set forth in these Terms and Conditions.

  3. The User may communicate with the Service Provider via email or the contact form. These communication methods ensure record-keeping (including date and time) and meet the requirements of a durable medium.
  4. The rules for using and subscribing to the Newsletter, delivery of Digital Content or Digital Services, and submitting inquiries are defined in these Terms and Conditions (hereinafter: the “Terms”).
  5. The Service Provider makes these Terms available before using the Newsletter service, in particular in the Website footer or next to the subscription form. The User may store or print the Terms.
  6. Use of the Newsletter requires acceptance of these Terms. By accepting them, the User confirms that they have read, understood, and agree to comply with them.
  7. The Service Provider is responsible for compliance of the service with these Terms.
  8. While using the Website and Newsletter, it is prohibited to provide unlawful content, including:
    • sending spam,
    • providing or transmitting illegal content, especially via forms.
  9. The User is obliged to:
    • use the Website and Newsletter in accordance with the Terms and applicable law,
    • not disrupt the functioning of the Website or Newsletter,
    • use content solely for personal purposes.
  10. The User may not use the Newsletter anonymously, under a pseudonym, or using false personal data.

  • Digital Service – a service enabling creation, processing, storage, or access to digital data
  • Digital Content – digital materials provided via Newsletter (e.g. emails, guides, PDFs)
  • Newsletter Service – delivery of Digital Content or Services via email
  • Order – User’s request to receive the Newsletter
  • Newsletter Form – subscription form on the Website
  • Data Transfer – providing personal data to use the service
  • Digital Environment – User’s devices, software, and internet connection
  • GDPR (RODO) – EU Regulation 2016/679
  • UŚUDE – Polish Act on Electronic Services
  • Telecommunications Law – Polish telecommunications regulations
  • Copyright Law – Polish copyright regulations

§ 3 MINIMUM TECHNICAL REQUIREMENTS

To use the Newsletter, the User must have:

  • internet access and a device (computer, laptop, mobile device),
  • an up-to-date web browser (e.g. Chrome, Firefox, Safari),
  • an active email account properly configured.

The Service Provider applies appropriate technical measures (e.g. SSL) to ensure security.

§ 4 TERMS OF NEWSLETTER SERVICE

  1. The Service Provider ensures quality, functionality, and updates of the Newsletter.
  2. Content reflects current knowledge at the time of creation.
  3. The Newsletter may be temporary or periodic.
  4. The Service Provider may change frequency or discontinue the Newsletter.

§ 5 SUBSCRIPTION PROCESS

  1. Subscription occurs via the Newsletter form or consent checkbox.
  2. The Service Provider uses MailerLite.
  3. The User must follow instructions sent via email.
  4. Required data:
    • name,
    • email address,
    • acceptance of Terms and Privacy Policy.
  5. Subscription constitutes consent to receive marketing communications.
  6. Consent is voluntary but necessary for the service.
  7. The User may withdraw consent at any time.
  8. Newsletter is provided indefinitely until:
    • consent is withdrawn,
    • service is discontinued.
  9. Inactivity for 1 year may result in removal from the mailing list.
  10. The system tracks user activity (opens, clicks, etc.).
  11. Remarketing may be conducted via platforms such as Meta (Facebook), in accordance with GDPR.

§ 6 DELIVERY OF DIGITAL CONTENT

  1. Newsletter is delivered promptly after subscription.
  2. Content is considered delivered when accessible to the User.
  3. Incorrect email or configuration issues are the User’s responsibility.
  4. Emails may land in spam folders.

§ 7 UPDATES AND CHANGES

  1. The Service Provider may update or modify the service due to:
    • technological changes,
    • legal requirements,
    • quality improvements.
  2. Changes are free of charge.
  3. Users will be informed in advance if changes significantly affect access.

§ 8 COMPLAINTS

  1. The Service Provider is liable for non-compliance at the time of delivery.
  2. Complaints must include:
    • User identification (name, email),
    • description of the issue.

§ 9 INTELLECTUAL PROPERTY

  1. Newsletter content is protected by copyright.
  2. Use is permitted only for personal purposes.
  3. Prohibited:
    • publishing,
    • copying beyond personal use.

Unauthorized use may result in legal liability.

§ 10 PERSONAL DATA

  1. The Service Provider is the data controller.
  2. Data is processed for service delivery and legal purposes.
  3. Data may be shared with service providers (e.g. hosting, mailing tools).

§ 11 FINAL PROVISIONS

  1. The service is provided in Polish under Polish law.
  2. The Service Provider may amend these Terms.
  3. Disputes are resolved by courts in Gdańsk.
  4. Applicable law: Polish law.
